Right of Withdrawal and Model Withdrawal Form

Scope: These withdrawal instructions apply to consumers (Section 13 of the German Civil Code (BGB)) who conclude a distance contract with the provider of the FlowLingua app for digital content (subscriptions).

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Tomas Chladek, Altkönigstr. 20, 61169 Friedberg, Germany, email: support@flowlingua.com) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below for this purpose, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we must reimburse all payments received from you, including delivery costs (with the exception of the additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of the reimbursement.

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount proportional to the services provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract, compared to the full scope of the services provided for in the contract.

Note: The statements on delivery costs follow the statutory model text; since these are digital content, no delivery costs are incurred.

Special case of digital content – expiry of the right of withdrawal

The contract on the use of FlowLingua concerns the provision of digital content (language learning features, translations, transcripts and other machine-generated content) that is not supplied on a physical medium.

If you, as a consumer, have expressly consented at the time of the conclusion of the contract to us commencing performance before the end of the withdrawal period and have confirmed that you are aware of losing your right of withdrawal as a result of this consent, your right of withdrawal expires at the start of the performance of the contract (Section 356(5) of the German Civil Code (BGB)).

Before the first purchase, the app obtains this express consent and acknowledgement in a separate step (checkbox in the purchase flow). Accordingly, the right of withdrawal expires when the paid subscription is first started or when the services are first used.

Note: The right of withdrawal relates to the first conclusion of a subscription or to new additional contracts. Automatic renewals of an ongoing subscription cannot be "withdrawn", but can be terminated at any time by cancelling in the Google Play subscription settings (cf. Terms of Service, Section 5).
